On August 24, 2023, the United States Sentencing Commission voted to give retroactive effect in certain cases to Parts A & B, subpart 1 of Amendment 821 (the criminal history amendments).  As Congress has elected not to act to the contrary, the U.S. Courts are authorized as of November 1, 2023, to conduct sentence reduction proceedings and enter orders pursuant to 18 U.S.C. §3582(c)(2) provided that any order reducing a term of imprisonment has an effective date of February 1, 2024, or later.  The Western District of Kentucky’s Protocol for addressing the retroactive application of the criminal history amendments is available here: General Order 2023-14
